Yesterday, CMS published the Final Rule in the Federal Register.... From the Federal Register: …… In other words, employers following CDC guidelines and the new requirements in this IFC may also be required to provide appropriate accommodations, to the extent required by Federal law, for employees who request and receive exemption from vaccination because of a disability, medical condition, or sincerely held religious belief, practice, or observance…... Personally, I think CMS should publish a list of RECOGNIZED medical conditions or religious beliefs, observances, or practices. This is the link to the Final Rule in the Federal Register…Be warned, it’s a VERY long document! www.federalregister.gov/documents/2021/11/05/2021-23831/medicare-and-medicaid-programs-omnibus-covid-19-health-care-staff-vaccination?fbclid=IwAR2mC3GT5oxxQZsttN-g7A8NnVa28o0NpSMjZa8ZZqI94qxaB4st9sOU49sAnd here is the link to the FAQ that makes it as clear as mud! www.cms.gov/files/document/cms-omnibus-staff-vax-requirements-2021.pdf?fbclid=IwAR0xntG3MyzSFkecb9zrzEEYQ2Dk-mV3-y94OODl8CdE9fVYCpQCHrmWxcY

I tried to get my exemption from my Dr. and the government only allows them to give exemptions for one scenario. So they are saying to get your exemptions for medical reasons, but not allowing doctors to give them to people. I was told by mine that they can only give an exemption in the instance that you got your first covid dose and you had an anaphylactic response to it. Then they can issue an exemption. All other medical issues basically don't matter.

All other medical issues basically don't matter. From what I've read that's pretty accurate. Another scenario that MIGHT work is a known (documented prior to) allergy to a component of a vaccine. The caveat to that is that the vaccines are different enough that if you are allergic to something in the Pfizer, it's likely not in one of the other 2.

Now OSHA has stopped their mandate as of yesterday. Wonder if CMS will follow suit since they are now being sued by quite a few states.

But a private medical employer can still require that their employees be vacinated, or else.

You are correct that the OSHA mandate has been put on hold, but just to clarify, that was done by a federal judge, not OSHA. It is on hold until the lawsuit is resolved.

How would you define "RECOGNIZED medical conditions or religious beliefs, observances, or practices."? From what I understand, the only medical exemptions are for an anaphylactic reaction to a first dose or a previously known allergy to a component of the vaccine. The caveat to that is that the vaccines are different enough that if you are allergic to something in the Pfizer, it's likely not in one of the other 2. I understand that Fresenius and Davita are being very liberal with granting "religious exemptions". IMHO, those exemptions are a crock as the leaders of all the major religions don't object to the vaccine. The only ones that do are like Bubba's Tabernacle of Worship and Tattoo Parlor.

Yeah Davita is allowing religious exemption, but you have to be able to back up a little. I think even a passage out of whatever book people subscribe to can count. Who knows? It's really just grasping at straws to prevent an exodus. Ba dum shhhh....

I have been approved for the medical exemption. The form is very vague and they don't even ask for a reason, just have to get a doctor to sign it. My doctor said that they were instructed not to sign exemptions due to legal reasons but my doctor doesn't like the idea of forced vaccinations. I do have valid medical conditions, cancer/chemo, if they ever do require proof. I know several that have been approved for religious and some that have been denied. They just changed it a little, resubmitted, and was approved. So don't give up if you don't succeed the first try.

Fresenius isn’t being “liberal” so I’m not sure where you’re getting your info from. On the most recent call 25% that applied for a religious exemption had it granted.
